Terms and Conditions

Please read these Terms and Conditions ("Terms", "Terms & Conditions") carefully before using the http://www.thelivio.com website (the "Service") operated by Livio Plus Inc. ("Livio", "LIVIO", "us", "we", or "our"). Your access to and use of the "Service" is conditioned on your acceptance of and compliance with these Terms & Conditions. These Terms & Conditions apply to all visitors, users and others who access or use the "Service".

By accessing or using the "Service" you agree to be bound by the below Terms & Conditions. If you disagree with any part of the Terms & Conditions then you may not access the "Service".

Purchases

If you wish to purchase any product or service made available through the Service ("Purchase"), you may be asked to supply certain information relevant to your Purchase including, without limitation to, your name, phone number, address, preferences, budget constraints, etc.

LIVIO provides interior decorating and styling services only. All design styling and decoration recommendations provided by us are served to improve the look of your space and are not intended for construction purpose.

Subject to agreement of the Terms & Conditions and purchase of our online design packages, we will provide our users with services based upon a fixed fee structure per room and the decoration process as detailed in the Design Services. We will try our best to accommodate clients’ requirements, once the final design package is sent out there will be no modifications done in the event of dissatisfaction.

LIVIO works to meet clients’ budget requirements. On occasion, furniture and delivery charges are subject to changes until the final purchase. The furniture prices and delivery fees estimated in the final design and decoration deliverables are based on the best available information on the project delivery date and are subject to changes.

Responsibility

Upon acceptance of the Terms & Conditions, users agree to correspond through online communication and phone calls if needed. No in-person visit will be conducted throughout our online interior styling and decoration service.

Users have responsibilities to provide interior decorating and styling services required information and questionnaire responses for LIVIO at each stage of the design and decoration process. The agreed timeline will be subject to change based on the time we receive the responses and information.

LIVIO only consults or advices on interior decoration or furnishings in conjunction with the sale, lease or supply of interior decorations or furnishings.

 

LIVIO only provides interior decoration services, including advising on and assisting in the selection of materials, window treatments, wall coverings, paint, floor coverings, fixtures and furnishings other than those materials, paint, floor coverings, fixtures and furnishings that are subject to regulation under any applicable fire code, building code or municipal code.

 

Interior decoration service provided by LIVIO will not be responsible for the means, methods or procedures of construction, fabrication, delivery & installation, or safety precautions in connection with the online decoration services; will not be responsible for the acts or omissions any contractor or subcontractor, supplier or other person performing the work on the online decoration project; or, for any failure of them to meet any schedules or completion dates.

 

Interior decorating and styling service by LIVIO cannot be held responsible for arranging repairs, replacement or freight claims for purchases made in conjunction with recommendations from the online design and decoration services.

 

For custom made items, including but not limited to shelf, closets and cabinetry, interior decorating and styling services provided by LIVIO will not be held responsible for any inaccurate dimensions that are given by the client. Any custom made items should be verified by the manufacturer as to final dimensions.

Payments

By submitting payments through the "Service", you authorize LIVIO to process your payments according to your instructions. You are responsible for any legal, regulatory, or banking penalties and fees that may be assessed for supplying false information to us for use with the "Service".

LIVIO accepts certain debit/credit cards and Alipay as described on the site as forms of payment, subject to certain restrictions, including, without limitation, territory restrictions, bank/payment card restrictions, spending limits, third party service provider restrictions or otherwise, which may prevent the processing of your purchase. If a transaction has been declined online due to payment card issues, please ensure all data is correct and resubmit. If the transaction is not accepted online, you will be unable to use that card for your transaction and should use another card. If a payment card company is being used for a transaction, we may obtain a pre-approval from the applicable payment card company for an amount up to the amount of the order. All purchases of products and services through the "Services" are final once you click the “Purchase” button and billing to your payment card occurs at such time or shortly thereafter. We shall not be liable to you, in any capacity, should your transaction be declined or otherwise not accepted by your payment card company.

 

Refunds

We are committed to 100% customer satisfaction rate but we understand sometimes special circumstances take place. If you change your mind before we deliver the concept boards, we will refund 60% of the original payment amount. If you change your mind after we deliver the concept boards but before the final design and furniture list, we will refund 20% of the original payment amount. We reserve the right, however, to provide you with a refund and/or a credit if we deem, in our sole discretion, such is appropriate given the circumstances.

Purchasing on behalf of the Client

Purchasing includes the initial order placement only. The client is responsible for arranging all deliveries, accepting all deliveries and associated costs. Any returns and exchanges of furniture and/or items for whatever reason are the sole responsibility of the client. LIVIO does not give any warranties or guarantees and is free of liability as it relates to furniture and/or items purchased on behalf of the client. It is the responsibility of the client to check custom order quotes and/or order confirmations for accuracy. LIVIO does not take responsibility for any orders placed incorrectly with the client’s approval and does not track furniture orders. LIVIO is not responsible for delays or cancellations on behalf of vendors and does not assemble furniture or any other ordered items.

Promotions

LIVIO may from time to time provide certain promotional opportunities to Users. All such promotions will be run at the sole discretion of LIVIO, and can be activated, modified or removed at any time by LIVIO without advance notifications.

 

Marketing and Public Relations

Our Service may contain links to third-party web sites or services that are not owned or controlled by LIVIO.

LIVIO has no control over, and assumes no responsibility for, the content, privacy policies, or practices of any third party web sites or services. You further acknowledge and agree that LIVIO shall not be responsible or liable, directly or indirectly, for any damage or loss caused or alleged to be caused by or in connection with use of or reliance on any such content, goods or services available on or through any such web sites or services.

 

LIVIO reserves the right to photograph and videograph of the finished online decoration project upon completion for marketing purposes and post the images to our website, social media platform, as well as various magazines and publications. Clients' names will not be used in conjunction with the images unless given permission by the client.

Changes

We reserve the right, at our sole discretion, to modify or replace these Terms & Conditions at any time. Please review it occasionally and before your use of our services. We will notify you before we make any material changes to the Terms & Conditions and give you an opportunity to review the revised Terms. What constitutes a material change will be determined at our sole discretion.

 

Any and all material changes shall come into effect between you and LIVIO upon your acceptance of such changes (e.g. by using our services after such notification has been made to you). If you object to any change in the Terms & Conditions you should immediately stop using our services.

 

Governing Law and Dispute Resolution

The Terms & Conditions shall be governed and construed in accordance with the laws in the Province of Ontario and the laws of Canada, as applicable. Both we and you hereby agree to submit to the non-exclusive jurisdiction of the Ontario Courts. All dealings, correspondence and contacts between us shall be made or conducted in the English language.
